In 2024, Colorado passed a law that would require social media platforms to display a health warning to any minors using their platform, either via a government-drafted message or language derived from government-approved or peer-reviewed research materials. NetChoice challenged the law, and the District Court of Colorado preliminarily enjoined the law because it likely violates the First Amendment. Colorado appealed.

On July 17, 2026, FIRE filed an amicus curiae brief with the American Civil Liberties Union, the Electronic Frontier Foundation and the Woodhall Foundation in support of the plaintiff with the U.S. Court of Appeals for the Tenth Circuit because the government should not force websites to distribute its negative opinions about social media.
