Fayette County, Kentucky: Local School Board Proposal Would Restrict Members’ Communications with the Press

Cases

Case Overview

FIRE Victory closed

The Fayette County Public School Board considered a proposal that would ban Board members from discussing dissenting votes with the press after a Board measure passes.  The policy would require Board members to “respect and support the collective decision of the Board.”

On December 3, 2025, FIRE wrote the Board explaining that this proposal violates the First Amendment. That same day, the district superintendent confirmed to FIRE that the Board would not be considering the policy proposal.
