Definitions of Prohibited Conduct
B. Sex or Gender Based Harassment: A type of discrimination that occurs when verbal, sexual, physical, electronic, or another form of conduct based upon an individual's sex or gender is so severe, pervasive, and objectively offensive that it unreasonably interferes with that individual's education, employment, or participation in a University program or activity.
C. Sexual Harassment: Means conduct on the basis of sex that satisfies one or more of the following:
i. An employee of ECSU conditioning the provision of an aid, benefit or service of the university on an individual’s participation in unwelcome sexual conduct;
ii. Unwelcome conduct determined by a reasonable person to be so severe, pervasive, and objectively offensive that it effectively denies a person equal access to the recipient’s education program or activity;
iii. Sexual assault (as defined in the Clery Act), or dating violence, domestic violence, or stalking as defined in the Violence Against Women Act (VAWA).
